Terms of Service

1. Scope

These Terms of Service apply to the use of the software "FleetSight", provided by Buildhaus Group Limited, a company registered in England and Wales (company no. 17294701), Paddock Cottage, Cooks Pond Road, Milland, Hampshire, GU30 7JY, United Kingdom (hereinafter "Provider").

2. Subject of Contract

The Provider makes available to the Customer a web-based fleet management software as Software-as-a-Service (SaaS). The scope of features depends on the selected plan.

3. Registration and Contract Formation

  • Registration grants a free 14-day trial with full feature access.
  • A paid contract is formed by selecting a plan and confirming payment.
  • After the trial expires, access is restricted to read-only mode until a paid plan is selected.
  • The customer must provide truthful information during registration.

4. Provider's Services

  • Provision of the software via the Internet (SaaS)
  • Regular updates and maintenance
  • Technical support according to the selected plan
  • Data backup according to our backup policies

5. Customer's Obligations

  • Confidential handling of access credentials
  • Use only for the intended purpose
  • Compliance with applicable laws
  • No misuse of the software

6. Prices and Payment

  • Current prices are shown in the pricing overview on our website.
  • All prices are exclusive of statutory VAT.
  • Billing is monthly in advance.
  • Payments are processed via Stripe.

7. Term and Termination

  • The free trial expires automatically after 14 days.
  • Paid plans can be cancelled monthly at the end of the billing period.
  • The right to extraordinary termination remains unaffected.

8. Data Protection

Our privacy policy applies. The Provider processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and, where applicable, the UK GDPR.

9. Liability

  • The Provider is fully liable for intent and gross negligence.
  • In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations.
  • Liability is limited to foreseeable, typically occurring damages.

10. Availability

The Provider aims for 99.5% availability on an annual average. Planned maintenance windows will be announced in advance.

11. Changes to Terms

The Provider reserves the right to change these Terms with reasonable notice. Customers will be informed of changes by email.

12. Final Provisions

  • The laws of England and Wales apply, without prejudice to mandatory consumer protection provisions of the customer's country of residence, including EU regulations and, for UK-based customers, the Consumer Rights Act 2015 and UK GDPR.
  • The place of jurisdiction is England and Wales, provided the customer is a business entity.
  • Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

13. Calculation Tools / No Tax or Legal Advice

Where the software provides automated calculation tools, those tools operate solely on the basis of data entered by the customer and general assumptions.

  • The results do not constitute individual tax, accounting, or legal advice.
  • Binding information on an individual tax situation may be given only by a qualified, licensed tax adviser or accountant.
  • The provider assumes no warranty for the correctness of the values shown, particularly in special cases, in the event of legal or regulatory changes, or with incomplete input data.
  • Before using any calculated values for accounting, payroll, or tax purposes, the customer is required to verify the values or have them verified by a qualified adviser.
